Senate Bill 23-206 introduced rules that increase disclosure about radon levels in real estate transactions and rental agreements in order to protect the health of buyers and renters.
These new rules went into effect on August 7, 2023. What’s changed?
For home sales:
- Sellers must disclose known radon test results and mitigation efforts.
- Contracts must include a warning about radon risks and testing recommendations.
For rental properties:
- Landlords must provide tenants with known radon test results and mitigation efforts before signing a lease.
- Tenants can void leases if landlords fail to disclose or address unsafe radon levels.
- Lease agreements must also include a warning about radon risks and testing recommendations.
